WAR team during counseling session in only 4 years old minor girl child rape case

1-The State vs. Shahid Hussain

Overview: 11-year-old Survivor ‘S’ was forcibly raped and sodomized by her father several times. Due to life threats by her father, survivor didn’t tell her mother anything about the sexual abuse for almost a year, until her health began to deteriorate. Survivor was paralyzed with fear when her mother asked her if something was wrong with her. 


Judgment:
The accused Shahid Hussain sentenced 14-years of rigorous imprisonment separately for offences punishable under sections 376 and 377 of the Pakistan Penal Code (PPC) and imposed a fine of Rs100,000. FIR No. 832/2019 had been lodged at the Model Colony police station.

2-The State vs. Shabbir

Overview: Survivor is minor girl. Her parents and elder sister were doing job. Survivor was playing with other children at her home. The accused Shabbir who is fiancé of her elder sister came to her home and told other children to leave the house. When they left, the accused took the advantage of the situation and forcibly raped her and threatened her.


Judgment:
The accused Shabbir sentenced 25-years rigorous imprisonment with a fine of Rs100,000 for sexual assaulting an 11-year-old girl. FIR No. 54/2019 had been lodged at the Ibrahim Hyderi police station under Section 376 of the PPC. In case of default on the payment of the fine, he would undergo an additional three-month imprisonment.

3-The State vs. Naeem

Overview: A minor girl ‘M’ of just 3 and half years age was brutally tortured and sexually assaulted by the accused, Naeem Ahmed. Her injuries were critical and dangerous to life.


Judgment:
The accused Naeem sentenced 14-year imprisonment for offence punishable under sections 376/511 and 337-A (i)/34 of the PPC and imposed a fine of Rs. 50,000. In case of failure in payment of fine, the accused shall further undergo imprisonment for the period of six month.

4-The State vs. Abdul Ghani

Overview: A9 years old minor girl was forcibly raped by her school Security Guard/Chowkidar, Abdul Ghani when all children including teachers etc. have gone from the school after the last period of the game. 


Judgment:
Xth ADJ west sentenced accused Abdul Ghani 10-years of imprisonment for an offence punishable under Section 376 of the PPC, and imposed a fine of Rs200,000. In case of failure in payment of fine the accused shall further undergo simple imprisonment for the period of six month. P.S Mochko had registered FIR No. 131/19.

5-The State vs. Saleem

Overview: As per complainant statement, on the day of incident at about 07:30 pm, her daughter ‘S’ aged 10 years went to know about the availability of water at Baloch Para, Sher Shah but she didn’t return back. The accused kidnapped her and raped her forcibly.


Judgment:
The accused was sentenced 10-year imprisonment and imposed a fine of Rs200,000 after he pleaded guilty to kidnap and rape the survivor. FIR No. 106/2015 had been lodged at P.S Sher Shah under sections 364-A/376 of the PPC.

6-The State vs. Ahmed Raza

Overview: A 16-years girl, Afshan was raped by her uncle, Ahmed Raza.

Judgment: The accused convicted 10-years imprisonment and 2 lac fine. FIR No. 03/21 was lodged at P.S Iqbal Market under section 376 of the PPC. 

7-The State vs. Aijaz Hussain

Overview:The survivor was teaching at one of the schools in her area.  The accused (Principal) asked a student to call her into his on the first floor. The accused then followed her from downstairs and dragged her into a close by room on the ground floor and raped her forcibly. 

Judgment: The accused has been convicted under section 376 PPC and sentenced to 10 years imprisonment and a fine of Rs. 20,000. In default of payment of fine, the accused shall suffer six months of additional simple imprisonment.

8- The State vs. Akmal

Overview: On the day of the incident, the victim was alone at her home. The victim’s father and her brothers were at work, while her siblings were at school. Her mother had passed away a few years back. The perpetrator is the victim’s neighbour who took the advantage of the situation and jumps into survivor’s home and forcibly raped her on gunpoint. 

Judgment: The accused sentenced five-year imprisonment and imposed a fine of Rs. 10,000.

9-The State vs. Iftikhar

Overview: 15-year-old survivor, ‘A’ was forcibly raped several times by her father’s friend Iftikhar. FIR No. 444/2019 had been lodged at P.S Mominabad by the complainant.

Judgment: The accused is convicted under s. 376 PPC for commission of rape with the survivor and he is sentenced to rigorous imprisonment for 10-year and fine of rupees two lac to be paid to the survivor in case of failure in payment of fine the accused shall further undergo simple imprisonment for the period of six months.

10- The State vs. Gulshan

Overview: Survivor, aged 16 years, had been repeatedly raped (incest) and tortured by her father since she was 14 years old and undergone horrific sexual and psychological trauma repeatedly for a long time in silence for fear of her life. Survivor and her family supported and strengthened by WAR’s absolutely free Legal and Counselling services and Survivor Support Program. 

Judgment: The accused is convicted under s. 376 PPC for commission of rape with the survivor and he is sentenced to rigorous imprisonment for fifteen (15) years and fine of rupees two lac to be paid to the survivor in case of failure in payment of fine the accused shall further undergo simple imprisonment for the period of six month

11- The State vs. Arif Shah & others

Overview: Victim was an only 7-year-old minor girl; she lived in Sachal Goth with her elder sister and her in-laws. She has been raped and murder. Accused is the victim’s brother in law. The four had been booked in this case. The FIR was lodged at the Sachal Goth police station, under sections 302 (murder), 376 and (i)/34 (punishment of rape and common intention) of the Pakistan Penal Code.

Judgment: Four men, including a brother-in-law of the victim, were sentenced death by Judge Nasim Akhtar of Anti-Terrorism Court No. 17.

12-The State vs. Mohammed Tahir

Overview: A 6 year-old minor was taken away by a young seminary teacher to a roof top of a Madrasa when she left her house to buy some sweets. The accused forcibly raped her and threatened to kill her and other family members if she disclosed the event to anyone.

Judgment: The accused has been convicted under section 376 of Pakistan Penal Code (PPC) and sentenced to life imprisonment with a fine of Rs. 50,000. In default of payment of fine, the accused shall suffer three months of additional simple imprisonment.

14-The State vs. Irfan Ali

Overview: The survivor was a 13 year-old girl. She was kidnapped and raped by a hotel worker. The survivor’s friend saw her when the accused kidnapped her, and informed her parents. The police arrested the accused and recovered the survivor.

Judgment: The accused has been convicted under section 364-A PPC and 376 PPC and sentenced to a rigorous imprisonment for 14 years with a fine of RS 50,000. In default of payment of fine, the accused shall suffer two months of additional simple imprisonment.

15-The State vs. Bashir Ahmed & other

Overview:  In this case two camel riders kidnapped, brutally raped, and murdered the 8/9 year old girl. They were identified by a motorcyclist when he was cleaning his motorcycle, who heard shouting while both accused tried to rape another small girl of the same age. He gathered people in the area and informed the police. The police arrested both the culprits. 

Judgment :  Bashir Ahmed and his accomplice both have been convicted under section 7(e) of Anti-Terrorism Act (ATA) 1997 and sentenced life imprisonment.

16- The State vs. Ubaid-ul-Haq

Overview: The survivor’s brother used to take his father to hospital due to cardiac problem. The accused is her father’s friend and he advised him to take spiritual treatment. The accused build trust on survivor’s family and advise her father to overcome such evil density we needed to write the holy book, QURAN- E- PAK in your daughter’s hand writing. He took her father’s permission writing training of Quran e Pak. But he raped her constantly, made a video, took picture and blackmailing and threatened her for the dire consequences if she discloses this matter to anyone. 

Judgment: The accused has been convicted under section 376 PPC and sentenced to a rigorous imprisonment for 14 years with a fine of RS 50,000/. In default of payment of fine, the accused shall suffer two months of additional simple imprisonment.

17- The State vs. khalil

Overview: A 9-years-old minor girl, ‘F’ was attempted to rape by a salesman, namely Akmal at a nearby bakery shop. FIR No. 45/2021 U/S 376/511 of the PPC had been lodged at Hyderi Market Police Station.

Judgment:  The accused Khalil sentenced ten-year imprisonment for offence punishable under sections 376 of the PPC and imposed a fine of Rs. 200,000. In case of failure in payment of fine, the accused shall further undergo imprisonment for the period of six month. FIR No. 130/19 had been lodged at P.S Ittehad Town. 

18- The State vs. Ashraf

Overview: Survivor ‘K’ aged only 7 years was attempted rape several times at night since last 4 months by her step father, Ashraf.

Judgment:  The accused Ashraf sentenced 3-years imprisonment for offence punishable under section 376/511 of the PPC. FIR No. 360/20 had been lodged at P.S Iqbal Market. 

19- The State vs. Abdulwadood

Overview: Survivor is only 7 years-old; she lived in Orangi town with her family. Accused is area people. Survivor was playing in porch at home with younger sister, the accused came in her porch after some time, survivor’s sibling went to inside her home, she was alone outside the accused called her, survivor asked him why, than accused forcibly took her inside his home and attempted rape her also threaten her, don’t disclosed it. Otherwise he will kill her and her family. 

Judgment:  The accused is convicted under s. 376/511 PPC for commission of attempted rape with the survivor and he is sentenced to imprisonment for 3 years and fine of Rs. 50,000 to be paid to the survivor in case of failure in payment of fine the accused shall further undergo simple imprisonment for the period of six month.
